This website is operated by dUS Travel. Throughout the site, the terms “we”, “us” and “our” refer to dUS Travel. dUS Travel offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.


Please read these terms and conditions carefully. By booking, you agree to abide by these terms and confirm that you have the authority to accept these terms on behalf of all persons included in your group.


Under no circumstances will a reservation be processed without first having accepted those TERMS AND CONDITIONS. Once a reservation is made, the following terms and conditions will take effect. You agree to abide by these terms.


Any new features or tools which are added to the current store shall also be subject to these Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.


By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your country, state or province of residence, or that you are at least the age of majority in your country, state or province of residence and have given us your consent to allow any of your minor dependents to use this site.


 

1. Contract 

All bookings are made with DUS Travel Nepal Pvt. Ltd. (Nepal) (Registration 190925/74/075). By booking a product with us you agree to these Terms and Conditions (which constitutes the entire agreement between you and DUS Travel Nepal).


You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).


You must not transmit any worms or viruses or any code of a destructive nature.


A breach or violation of any of the Terms will result in an immediate termination of our Services.


The services to be provided are those referred to in your booking confirmation invoice.



2. General Conditions 

We reserve the right to refuse service to anyone for any reason at any time.


You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.



3. Your personal details  

You must provide all accurate and necessary details in your login account or by email at the time of booking. Details required vary by package types (number of people traveling, starting date, full name as per passport, nationality, passport number, passport copy, proof of travel insurance, medical conditions and more details are sometimes required depending upon the product chosen).


If some details are missing, additional charges may apply.



4. Age requirements

To travel independently, you must be at least 18 years old. There are no upper age limits for most of our trips; however, some trips are catered to adventurers and a good level of fitness is required. An adult must accompany all children under the age of 18. The minimum age varies depending on holiday types. Our standard holidays are open to children aged 13 years or older when accompanied by a parent. Some of our adventurous holidays have a higher minimum age.



 

5. Health requirements

 

It is your responsibility to provide us at least two months prior to travel your health requirements. By booking with us, you imply that you and your group members are fit to take part in the package you are undertaking.



6. Private tours, small group bookings, solo trips and corporate holidays

We offer private and small group holidays. On most of our fixed departure tours, you’ll be traveling with a small group of 6-12 people, though the average size of a group is about 8-10 people. Of course, it is possible to book holidays for larger groups as well. We also organize solo trips and corporate holidays.



7. Deposit

We require a per-person non-refundable deposit of 20% of your package cost to hold your booking and secure your place. This deposit amount is not refundable.

 

If booking is made within 14 days of the departure date: full amount is payable at the time of booking.

There are different deposit amounts according to the package booked. The deposit (20%) will be applied towards the cost of your package. Your balance is due later.


Between 56 days and 79 days before the departure/ start date, only the deposit is forfeit (20% of your package cost). Thereafter a percentage of the total cost of the tour will be due:

-       between 55 and 15 days: 50%,

-       between 14 days and 7 days: 100%.

 

8. Payments   

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per group or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our agency. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

From date of confirmation invoice, a contract will exist between you and DUS Travel Nepal or if you book within 14 days before departure, the contract will exist when we accept your payment.

The confirmation invoice will contain the details of your final payments.

Please note that some 'special offers' require payment to be made at the time of booking. For some other packages, we only require a per-person deposit to hold your booking and you can pay in 1, 2 or 3 times before the due date.

Between 56 days and 79 days before the departure date, only the deposit is forfeit (20%). Thereafter a percentage of the total cost of the package (balance) will be due:

- between 55 and 15 days: 50%, 

- between 14 days and 7 days: 100%.

Payment of the balance of the package price is due 14 days before the start date. Full payment is required earlier for expedition bookings.

If the balance is not paid on due date, we reserve the right to cancel your booking.



9. Prices & additional charges 

All prices are stated in US dollars. The currency exchange rate and foreign transaction fee is determined solely by your bank on the day that they process the transaction.

 

Prices for our products are subject to change without notice. Our prices are subject to variable and seasonal pricing (standard practice within the travel industry). Our prices may vary at any time (market conditions and availability). It is possible that different customers on the same package may be charged different prices (discount, time of booking, length of stay, etc.). Once you have received a quote the price will be locked. Discounts that may occur after will not apply.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

We reserve the right to impose surcharges (up to 10% of the package price) before departure due to local reasons (exchange rates, increase of costs, taxes, etc.).

There is also a possibility of surcharge to all purchases made by credit card. Most of our holidays are usually based on twin sharing basis. Thus, a single room supplement is sometimes applicable. As a solo traveler, you have two options:

• You can be paired up with another traveler of the same gender (Shares are not guaranteed). 

• You will pay for a single supplement if you don’t want to share a room with someone else. 

Please note that a levy of up to 3% may be applied to all purchases made by credit card/ debit card.



10. Cancellation  

We need to receive your cancellation by email at [email protected].

If you cancel some or all portions of your booking, cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation. If you cancel your package:

- 56 days or more prior to departure, we will retain the deposit (20%);

- between 30 and 55 days prior to departure, we will retain 30% of the total booking cost;

- between 15 and 29 days prior to departure, we will retain 50% of the total booking cost;

- between 4 and 14 days prior to departure, we will retain 80% of the total booking cost;

- 3 days or less prior to departure, we will retain 100% of the total booking cost. 

We advise to take a cancellation insurance at the time of booking which will cover cancellation fees.

If you leave a holiday or any other trips or projects for any reason after the departure date, we don’t have the obligation to give you a refund.  

In case you don’t join in, join after departure, or leave prior to the end date, no refunds are sure to be made by us.

 

11. If dUS Travel cancels the package?

If dUS cancels before the starting date, you will be fully refunded of the price you paid us for your package (but we are not responsible for air flights cancellation and other expenses that incurred as result of booking) or you can keep your deposit for another travel product.

 

12. Travel insurance

Travel insurance is mandatory. You are required as a condition of booking to have an adequate travel insurance. You must provide proof of your travel insurance at the time of booking; you will not be able to join the trip without it. 

If you are planning to travel to high altitude, please check what your insurance policy covers as many insurances do not provide cover above 2,500 meters. You will need a full insurance covering medical treatments, accidents and evacuation by helicopter. 

It is also a good option to choose an insurance that covers flights cancellation and unexpected losses and damages.


13. Inclusions/ Exclusions 

Please refer to each packages’ details for costs inclusion and exclusion. Anything not specified in the ‘what’s included’ sections are excluded.



14. Visas 

You must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for the countries in which you will visit during your trip. Your passport must be valid for 6 months beyond the duration of the trip. 


Please ensure that all your travel, passport, and visa documents are valid and in order before arriving.


We are not responsible if you are refused entry to a country.



15. Itinerary and program details

Please note that itineraries are intended to be a guideline; local conditions and weather may necessitate slight itinerary variations without prior notice.

If major changes occur, we will inform you as soon as reasonably possible.

 

16. Optional activities

Optional activities are not included in packages prices. Optional activities do not render us liable for them in any way if you choose to contract them there with our representative. The contract for the provision of that activity will be between you and the activity provider. 



17.  Packages guidelines & Authority on tour 

All our packages are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety of travelers and staff members. If you don’t respect the group leader decision, he can ask you to leave with no refund.


By booking, you agree to respect the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to respect our responsible travel guidelines. 

 

18. Privacy policy

Any personal information that we collect about you may be used for any purpose associated with the operation of one of our packages, or to send you marketing material in relation to special offers or events.


The information may be disclosed to our partners, service providers or other suppliers to enable us to operate the trip. 


Otherwise, we will treat your details in accordance with our privacy policy (available on our website). 

 

19. Comments, Feedback and other submissions by the user

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions.


You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

 

20. Acceptance of personal risk

You acknowledge that some of our trips involve a degree of personal risk. You are responsible to acquaint with all relevant travel information and the nature of the package chosen. You accept that you are aware of the personal risks attendant upon each travel experiences we offer.

 

21. Liability

a. We are not liable for the negligence of our staff or agents causing death or physical injury or loss or damage to personal property.

b. We shall not be liable for any damage or loss if the failure to respect the contract is:

- attributable to you,

- attributable to a third party unconnected with the services contracted and in case of unforeseeable or unavoidable events,

- attributable to unforeseen and unusual circumstances beyond our control,

- attributable to political disputes, border closures, refusal of visas, industrial action, climate or other matters of a similar nature and any other force majeure,

- attributable to an event which dUS Travel could not foresee or forestall.

c. Our acceptance of liability above is subject to assignment by you of your rights against any agent, supplier or sub-contractor which is responsible for the unsatisfactory arrangements or your death or personal injury.

 

22. Conduct

Inappropriate conduct (including damage, poor hygiene, excessive noise, etc.) may result in immediate termination of our contract without refund and the offender may be forced to leave.

 

23. Complaints

If you have a complaint during your stay, please inform your group leader or our local representative. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the package.

 

24. Severability

In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

25. Marketing

You agree that we are allow to use images of you taken during your travel for advertising and promotional purposes.  You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes. If you do not wish to appear on these videos/photos, please notify us at [email protected].

 

26. Applicable law

The laws of Nepal govern these Terms & Conditions to the fullest extent allowable.  Any disputes in connection with these Terms Conditions must be initiated in the courts of Nepal.
